Why do I need a written contract?

If you have a written contract you can avoid most misunderstandings about who is responsible for what on the project. You can tie down the price and tie down what you are getting. Many cases we get involve misunderstandings about what the scope of the work was going to be or who would be responsible for certain items or repairs. These problems frequently arise either because there is no written contract or because the written contract was drafted with amibigous or incomplete language. The cost to litigate over the problems after the fact are much higher than the cost to have a proper contract drafted that is understandable to the parties and accepted by those involved. Want to Know the Status of Your Case?

Do you have a case pending and you don't know what documents have been filed with the Court. In Idaho, the Court system has made the documents that are filed in most cases public records. You can check the Court's file yourself online by going to https://www.idcourts.us/repository/start.do. From there you can enter your name or your case number and look up a list of all of the documents that have been filed in your case. Or you can check all of the traffic tickets you've gotten in a specific county. If you need specific help finding where your case is at, speak to your attorney. Information We Need to File Your Lien Claim

The more information you can bring with you to your first appointment with us the more productive it can be. That is true regardless of the type of case, whether it is a lien, a construction dispute, a DUI, collection, or defense of a lawsuit. However, in order to file a lien there is some information that we absolutely must have to file it properly. If you don't have all of the information at the time of our first visit, we can help you get the information, but we must have it to ensure that your lien is validly filed.

That information includes:
  1. Owner's name and mailing address (verify with County Assessor),
  2. Physical address of improved property,
  3. Full legal description of improved property (NOT tax parcel number)
  4. Subcontractors' name and mailing address,
  5. First MONTH material or labor supplied,
  6. Last DAY material or labor supplied,
  7. Balance presently owed after all just credits and offsets,
  8. Interest rate applicable to balance,
  9. Interest amount accrued since last work or material supplied,
  10. A copy of the most recent billing statement or invoice,
  11. A copy of any credit application or personal guarantee.

Who We Are

Fuller and Beck used to be known as Fuller and Carr. The law firm consists of three practicing attorneys and one attorney who is of counsel. The practicing attorneys include Mark Fuller, Daniel Beck, and Paul Fuller. Steve Carr is of counsel and remains with the firm.

Mark Fuller has been practicing law all over the state of Idaho since the early 1980s. His practice mainly focuses on construction disputes and in representing various construction companies in many types of litigation including actions before Planning and Zoning Commissions, collections, employment, contracts, mechanics liens, and general litigation. Daniel Beck has practiced with the firm since 2005. Daniel Beck practices commericial litigation, collections, general litigation, water law, and agricultural law. Paul Fuller joined the firm in September of 2010 after passing the bar and being admitted to practice law in the State of Idaho. Steve Carr's many commitments outside the law prevent him from actively participating with the firm, however, he is still a member.

We accept cases and have tried cases in St. Anthony, Island Park, Driggs, Sun Valley, Idaho Falls, Blackfoot, Pocatello, and many other areas in Eastern Idaho.
